1. Acceptance of Terms

By downloading, accessing, or using the “Intimately” mobile application (“the App”), you agree to these Terms and Conditions (“Terms”). If you do not agree, you must refrain from using the App. Use of the App is subject to our Privacy Policy. We comply with applicable data protection laws, including CCPA for California residents.

2. Eligibility

The App is intended for users aged 18 and older. By using the App, you confirm that you are at least 18 years old and legally capable of agreeing to these Terms.

3. Subscription and Payment

The App offers multiple subscription tiers, with payments handled through the respective app stores (e.g., Apple App Store, Google Play Store). Subscription fees are billed in advance and renewable based on your selected plan. You may cancel your subscription at any time, but refunds for partial periods are subject to the respective app store’s guidelines, which may take precedence.

4. User Conduct

You agree not to:

• Use the App for illegal purposes.
• Share App-generated content (e.g., challenges) without consent from all involved parties.
• Hack, reverse-engineer, or disrupt the App.
• Provide false information during onboarding.

5. Intellectual Property

All App content, including text, challenges, designs, and AI technology, is owned by SMAZENKA LABS LLC and protected by copyright, trademark, and other intellectual property laws. You retain ownership of any user-generated content (UGC) you create using the App. By submitting UGC, you grant SMAZENKA LABS LLC a worldwide, non-exclusive, royalty-free license to use, reproduce, and modify your UGC solely for the purpose of operating and improving the App. We will not share your UGC with others without your consent.

6. Disclaimer of Liability

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. SMAZENKA LABS LLC IS NOT RESPONSIBLE FOR ANY HARM, INJURY, OR DAMAGES RESULTING FROM YOUR USE OF THE APP OR FROM FOLLOWING ITS SUGGESTIONS, CHALLENGES, OR ADVICE. ALL RISKS ASSOCIATED WITH YOUR ACTIONS, INCLUDING PHYSICAL, EMOTIONAL, OR LEGAL CONSEQUENCES, ARE SOLELY YOURS TO BEAR. You are responsible for ensuring that all activities are consensual, safe, and appropriate, using your own judgment.

7. Termination

SMAZENKA LABS LLC may suspend or terminate your access to the App without notice if you violate these Terms or engage in conduct harmful to the App, its users, or third parties.

8. Governing Law

These Terms are governed by the laws of the United States, as SMAZENKA LABS LLC is a US-based company, excluding its conflict of law provisions.

9. Changes to the Terms

We may update these Terms as needed. Significant changes will be posted within the App, and your continued use thereafter indicates acceptance.
